Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Data Chasing LLC, doing business as Local Lead Legend ("Local Lead Legend," "we," "us," or "our"). By accessing our website, submitting your information, or using our services, you agree to be bound by these Terms.

1. Services

Local Lead Legend provides AI-powered lead generation, marketing automation, SMS outreach, and growth audit services for local home service businesses, including but not limited to plumbers, HVAC contractors, electricians, roofers, landscapers, painters, and general contractors. Specific services are as described in any applicable service agreement, proposal, or order form.

2. Eligibility

To use our services, you must:

Be at least 18 years of age
Be legally capable of entering into binding contracts
Operate a legitimate, law-abiding business
Comply with all applicable local, state, federal, and international laws

3. Billing and Payment

Subscription fees are billed monthly in advance. Setup fees, onboarding fees, and any services already rendered are non-refundable. Payment is processed via Stripe. You authorize us to charge your payment method on file for all applicable fees. Failure to pay may result in service suspension or termination.

4. SMS Communications and TCPA Compliance

By providing your phone number and checking the SMS consent checkbox on our website, you expressly consent to receive automated text messages from Data Chasing LLC (Local Lead Legend). These messages may include:

Audit confirmations and scheduling updates
Appointment reminders and missed call notifications
Transactional service communications
Marketing messages (if you separately opted in)

Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message. Reply HELP for assistance. We comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and A2P 10DLC carrier requirements. We are registered with The Campaign Registry (TCR).

Consent to receive text messages is not a condition of purchase or service.

5. Client Obligations

By using our services, you agree to:

Provide accurate, complete, and current information at all times
Respond promptly to leads delivered through our system
Comply with all applicable communications laws, including TCPA, CAN-SPAM, GDPR, and CCPA, when contacting leads
Obtain all required consents before messaging leads in your own campaigns
Honor opt-out requests promptly and maintain consent records
Maintain proper business licensing and insurance for your trade
Not use our services for spam, deceptive practices, or unlawful purposes
Not submit false, misleading, or fraudulent information

You are solely responsible for service fulfillment to your customers. Local Lead Legend is not responsible for the quality of services you deliver.

6. No Performance Guarantees

Our services are provided on an "as is" basis. We do not guarantee specific lead volume, conversion rates, revenue outcomes, or business results. Marketing performance depends on many factors outside our control, including your market, offer, response time, and competitive landscape. Past results achieved by other clients do not guarantee your results.

7. Intellectual Property

All content on localleadlegend.com, including text, graphics, logos, software, and designs, is the property of Data Chasing LLC and protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you agree to the collection and use of information as described therein.

9. Third-Party Services

Our services may integrate with or rely on third-party platforms including GoHighLevel, Telnyx, Stripe, Meta, Google, and Supabase. Your use of those platforms is governed by their respective terms of service. We are not responsible for third-party service outages, changes, or data practices.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, LOCAL LEAD LEGEND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DATA CHASING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Data Chasing LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your failure to comply with applicable communications laws when contacting leads.

13. Termination

Either party may terminate the service relationship at any time. We reserve the right to suspend or terminate your access immediately for non-payment, violation of these Terms, abusive behavior, or at our sole discretion with reasonable notice. Upon termination, your right to use our services ceases immediately. Sections that by their nature should survive termination will survive.

14. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our services will first be subject to informal resolution. You agree to contact us at hello@localleadlegend.com and allow 30 days for good-faith resolution before initiating any formal proceeding.

If informal resolution fails, disputes will be resolved by binding individual arbitration. You waive any right to participate in a class action lawsuit or class-wide arbitration. Arbitration will be conducted under the rules of the American Arbitration Association (AAA).

15. Governing Law

These Terms are governed by the laws of the United States and the state in which Data Chasing LLC is registered, without regard to conflict of law provisions. To the extent arbitration does not apply, you consent to the exclusive jurisdiction of the applicable courts.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use of our services after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
